İşbu Mesafeli Satış Sözleşmesi (“Sözleşme”), aşağıda bilgileri bulunan ALICI ile SATICI arasında, aşağıda belirtilen hüküm ve şartlarda elektronik ortamda kurulmuştur.

2. Konu
İşbu Sözleşme, ALICI'nın SATICI'ya ait www.bahcemsigacik.com internet sitesinden elektronik ortamda siparişini verdiği aşağıda nitelikleri ve satış fiyatı belirtilen ürün(ler)in satışı ve teslimi ile ilgili tarafların hak ve yükümlülüklerini düzenler.

4. Teslimat
Ürün, ALICI'nın sipariş formunda belirtmiş olduğu adrese, mevzuata uygun şekilde, ALICI veya ALICI'nın gösterdiği kişi/kuruluşa teslim edilir. Teslimat süresi, stok durumuna göre değişiklik göstermekle birlikte, en geç 30 (otuz) gün içinde gerçekleştirilir.

Ödeme işlemi, SATICI'nın anlaşmalı olduğu banka altyapısı ve güvenli ödeme sistemleri üzerinden gerçekleştirilecektir.

6. Cayma Hakkı
ALICI, 14 gün içinde herhangi bir gerekçe göstermeksizin ve cezai şart ödemeksizin cayma hakkına sahiptir. Cayma hakkının kullanılması için, bu süre içinde SATICI'ya yazılı bildirimde bulunulması şarttır.

Cayma hakkı kullanılamayacak ürünler:

ALICI'nın özel istekleri veya kişisel ihtiyaçları doğrultusunda üretilen ürünler.

Kurulumu yapılan ve montajı tamamlanan ürünler.

7. İade ve İptal Prosedürü

Cayma hakkı kapsamında iade edilen ürünlerin kargo bedeli ALICI’ya aittir.

İade edilen ürünün, ambalajı ve tüm aksesuarları ile eksiksiz ve kullanılmamış olarak gönderilmesi gerekmektedir.

İade onayı sonrası bedel en geç 14 gün içinde iade edilir.

8. Yetkili Mahkeme
İşbu sözleşmeden doğacak ihtilaflarda, her yıl Ticaret Bakanlığı tarafından ilan edilen parasal sınırlara göre, ALICI'nın ve SATICI'nın ikametgahının bulunduğu yerdeki Tüketici Hakem Heyetleri veya Tüketici Mahkemeleri yetkilidir.

9. Yürürlük
ALICI, www.bahcemsigacik.com internet sitesi üzerinden gerçekleştirdiği sipariş işlemi öncesinde işbu Sözleşme'yi okuyup kabul ettiğini beyan eder.

10. SÖZLEŞME ŞARTLARI

Sipariş listesinde belirtilen ürün, adet, fiyat, kumaş uygulamaları ve diğer tüm bilgiler müşteri tarafından kontrol ve kabul edilmiştir.

Ürün ölçülerimiz standart olup, bu ölçülerin müşterinin kullanım alanına uygunluğundan müşteri sorumludur.

Müşterinin kurulum talep ettiği alanın uygun olmaması, taşıma zorlukları veya bina koşulları nedeniyle doğacak ek masraflar (asansör vb.) müşteriye aittir.

Müşteri özel üretim veya kişisel tercihlere göre hazırlanan ürünlerde cayma hakkının bulunmadığını kabul eder.

Teslim için müşteriden randevu alınacaktır. Müşteri, kendisine ulaşılabilecek bir telefon numarası vermek zorundadır.

Müşteri teslimat öncesinde ödeme yükümlülüklerini yerine getirmekle yükümlüdür.

Siparişten cayılması halinde, özel üretim ürünlerde üretim maliyetine karşılık olmak üzere %30 cayma bedeli uygulanabilir.

Teslim süresinin 1-10 iş günü aşılması durumunda sözleşme feshi talep edilemez.

Teslim tarihinden itibaren 6 ay içinde teslim alınmayan ürünlerden dolayı sorumluluk müşteriye aittir.

Teslim formu ve garanti belgesi imzalanmak zorundadır.

Tarafların sözleşmede belirtilen adresleri resmi tebligat adresidir.

Teslim alınan ürünlerin ayıplı olup olmadığının kontrolü müşteriye aittir. Sonradan oluşan kullanım kaynaklı sorunlardan firma sorumlu değildir.

Tüm uyuşmazlıklarda İzmir Mahkemeleri ve İcra Daireleri yetkilidir.

This Distance Sales Contract ("Contract") is established electronically under the following terms and conditions between the BUYER and the SELLER, whose information is provided below.

2. Subject

This Contract regulates the rights and obligations of the parties regarding the sale and delivery of the product(s) whose specifications and sale price are specified below, ordered electronically by the BUYER via the www.bahcemsigacik.com website owned by the SELLER.

4. Delivery

The product shall be delivered to the address specified by the BUYER in the order form, to the BUYER or to a person/organization designated by the BUYER, in accordance with legal regulations. The delivery time may vary depending on stock status, but shall not exceed 30 (thirty) days.

The payment will be processed through the secure payment systems and banking infrastructure contracted by the SELLER.

6. Right of Withdrawal

The BUYER has the right to withdraw from the contract within 14 days without providing any reason or paying any penalty. A written notice must be sent to the SELLER within this period to exercise the right of withdrawal.

Products for which the right of withdrawal cannot be used:

Products manufactured upon the BUYER’s special requests or in line with their personal needs.

Products that have been assembled or installed.

7. Return and Cancellation Procedure

The shipping cost of returned products within the scope of the right of withdrawal shall be borne by the BUYER.

The product must be returned complete, unused, and with all packaging and accessories intact.

Upon approval of the return, the payment will be refunded within 14 days at the latest.

8. Competent Court

In disputes arising from this contract, Consumer Arbitration Committees or Consumer Courts in the jurisdiction of the BUYER’s or SELLER’s residence, within the monetary limits announced annually by the Ministry of Trade, shall be authorized.

9. Enforcement

The BUYER declares that they have read and accepted this Contract before placing an order through www.bahcemsigacik.com.

10. TERMS OF THE CONTRACT

The products, quantities, prices, fabric specifications, and all other details listed in the order are reviewed and approved by the customer.

Our product dimensions are standard, and it is the customer's responsibility to ensure suitability for their intended use.

Any additional expenses due to site inaccessibility, transportation difficulties, or building conditions (e.g., elevator costs) shall be borne by the customer.

The customer acknowledges that the right of withdrawal does not apply to products specially produced or customized according to personal preferences.

An appointment will be scheduled with the customer for delivery. The customer must provide a reachable phone number.

The customer is obligated to fulfill payment responsibilities before delivery.

In the case of cancellation of custom-made products, a withdrawal fee of up to 30% may be charged to cover production costs.

The contract cannot be terminated if the delivery time is exceeded by 1–10 business days.

The customer is responsible for unclaimed products within 6 months from the delivery date.

The delivery form and warranty certificate must be signed.

The addresses stated in the contract are the official notification addresses of the parties.

It is the customer’s responsibility to inspect the products for defects at delivery. The company is not responsible for issues arising from misuse.

All disputes shall be resolved by İzmir Courts and Enforcement Offices.
